Established relief for proposed use as per BZA Variance #1444. The applicant has agreed to all of the following conditions: (1) the operator will close no later than 10 pm or earlier if they chose to do so. (2) the operator has filed a covenant and restriction at the County Clerk's Office embodying these conditions. (3) there will be no on premises sale of alcohol but the operator may serve beer and wine. (4) should the operator seek to expand or change their business they will return to the Board of Zoning Appeals to amend these conditions. (5) this relief is personal to the applicant and should the business be sold or ownership of Moksha Café change, any new owner must apply to this Board for relief. (6) the operator will not seek a liquor license seeking to sell alcohol (7) the operator will not offer amplified music beyond the confines of the building. All music will cease at 9pm weekdays, and at 10pm Saturdays and Sundays.
